Counter affidavit on behalf of respondent No. 3 through Shri Sanjay Kumar Srivastava filed today is taken on record.
Heard Shri Sushil Kumar Pandey, learned counsel for petitioners and Shri Sanjay Kumar Srivastava for respondent No. 3.
The present petition has been filed for issuance of a writ, order or direction in the nature of Certiorari to quash the First Information Report dated 29.4.2019 registered as Case Crime No. 166 of 2019, under Sections 498-A, 354- A, 323, 504 IPC and Section 3/4 of Dowry Prohibition Act, PS Jani, District Meerut with a further prayer not to arrest the petitioners pursuant to the said case.
Learned counsel for parties jointly stated that the matrimonial dispute has come up to be amicably resolved under a notarial affidavit dated 21.05.2019.
If that be so it is always open for either of the parties to approach the Investigating Officer concerned who shall proceed to file an appropriate report under Section 173 (2) Cr.P.C. without further delay. However, in the event any dilatory tactics are adopted, it will be open for the petitioner to approach the Senior Superintendent of Police, Meerut along with a certified copy of this order who shall do the needful as expeditiously as possible so that the parties are not put to any irreparable loss.
The petition is disposed of.
