Richa Srivastava vs Canara Bank Bangalore Thru ...

High Court Of Judicature at Allahabad|31 July, 2019

JUDGMENT / ORDER

Heard Ms. Bulbul Godiyal, learned Senior Advocate, assisted by Sri Sartaj Ali Ansari, learned counsel for the review-applicant.
By means of this review application, the applicant has sought review of the order dated 23.7.2019 passed by this Court in the present writ petition raising couple of grounds.
The main ground being raised in the review application is that there are more than one posts at Lucknow Circle as per the status of the petitioner but since the petitioner has approached this Court, therefore, the request to retain the petitioner-applicant at Lucknow Circle has not been acceded to.
Ms. Bulbul Godiyal, learned Senior Advocate has submitted that the request of the petitioner was bonafide, therefore, the authorities concerned should have passed appropriate orders but without considering the bonafide request of the petitioner, the authority concerned has passed the order dated 25.7.2019, which is contained in Annexure No.3 to the review application.
Having heard learned counsel for the review applicant, I do not find any legal error apparent in the order dated 23.7.2019, therefore, this review application is rejected.
It has been informed at the Bar that the last date for joining of the petitioner was 29.7.2019 but since the petitioner was having legitimate expectation that if she files a review application, this Court would consider the same and this is the reason that she could not submit her joining by 29.7.2019, therefore, Ms. Bulbul Godiyal, learned Senior Advocate has requested that some time for joining at Bhopal may be provided to the petitioner.
On the aforesaid request and considering the fact that the petitioner has filed the present review application on 29.7.2019 itself, therefore, the petitioner may submit her joining at Bhopal within a week from today and if the petitioner submits her joining at Bhopal within a week from today, the competent authority at Bhopal shall accept the joining of the petitioner strictly in accordance with law and no coercive action shall be taken against the petitioner in the meantime.
However, it is always open to the petitioner to submit a fresh representation to the superior authorities/ competent authority of the Bank even after submitting her joining at Bhopal taking all pleas and grounds, which are available to her, enclosing therewith the copies of relevant documents, which are necessary for disposal of the representation and if such representation is preferred by the petitioner to the competent authority, the same may be considered and decided by speaking and reasoned order, strictly in accordance with law, considering the compassion of the petitioner, preferably within a period of two months from the date of receipt of the representation and thereafter decision thereof shall be communicated to the petitioner forthwith.
Order Date :- 31.7.2019 RBS/-
