By order dated 20.12.2017, passed in application under Section 482 Cr.P.C. bearing No. 42473 of 2017 filed by the applicant, this Court directed the Court below to decide Misc. execution application No. 38/11 of 2017 under Protection of Women from Domestic Violence Act by fixing short dates and without granting unnecessary adjournment.
Counsel for the applicant has drawn attention of this Court towards order sheet, wherefrom it transpires that on 27.04.2018, the court after hearing the parties on applications dated 09.03.2018 and 05.07.2017, fixed 11.05.2018 for orders, but no order was delivered on the said date and since then opposite party is fixing dates for further hearing. It is also evident from the order sheet that although order was not delivered even after hearing, but the court below is fixing short dates in the matter.
Having regard to the above facts, this Court is not inclined to proceed in contempt at this stage, but if the proceedings are not concluded expeditiously, keeping in mind the spirit of the order dated 20.12.2017, even within three months from the date of production of certified copy of this order, it shall be open to the applicant to move to this Court again by way of fresh petition.
