It is the contention of the learned counsel for the petitioner that without hearing the petitioner, the order of suspension had been passed under Section 17(3) of the Arms Act.
Learned counsel for the petitioner submitted that the matter is fully covered by a decision of this Court reported in 2012 (76) ACC 1 : Bhupendra Singh And Another vs State Of U.P. And 7 Others.
Under such circumstances, the order dated 11.12.2020 passed by the District Magistrate is quashed to the extent it suspends the fire arm licence of the petitioner.
However, enquiry shall continue and shall be completed within a period of two months from the date of presentation of a copy of this order. Copy of this order would be duly certified by the petitioner's counsel.
With these observations, the writ petition is disposed of.
