A tenant in RCP No.56/2008 on the file of the Rent Control Court Ernakulam, who is the appellant in RCA No.8 of 2011 on the file of the Rent Control Appellate Authority is the revision petitioner. The petitioner challenges the concurrent findings of the Rent Control Court and the Appellate Authority under Section 11(3) of the Kerala Buildings (Lease and Rent Control) Act, 1965.
2. The learned counsel appearing for the petitioner/tenant and the respondents/landlords submitted before us that the parties have settled their disputes and differences and they have arrived at the following terms:
i) The tenant shall surrender the petition schedule building to the landlords on or before 31/07/2014. The tenant shall file an affidavit before the executing court within 15 days from today, unconditionally undertaking to vacate the petition schedule building on or before 31/07/2014.
ii) The parties agree that rent from January 2014 is payable by the tenant at the rate of Rs.6,455/- (Rupees Six Thousand Four Hundred and Fifty Five only) per month. It is also agreed by the parties that the landlords are bound to pay a sum of Rs.1,00,000/- (Rupees One Lakh only) on surrender of the building, the amount being the security deposit. It is also agreed that the landlords would be entitled to adjust the monthly rent payable from January 2014 to 31/07/2014 from the aforesaid amount of Rs.1,00,000/- and that they need to pay to the tenant only the balance amount on surrender of the building. The landlords agree that they shall file an affidavit before the executing court within 15 days from today, unconditionally undertaking to pay to the tenant a sum of Rs.1,00,000/- after adjusting the rent from January 2014 to 31/07/2014 at the rate of Rs.6455/- per month.
iii) It is agreed that this order shall be treated as an executable order of the Rent Control Court.
Rent Control Revision is disposed of in terms of the compromise arrived at between the parties as mentioned above.
