(By Sri S.Rajashekar, Advocate) … Petitioner … Respondent This Criminal Revision Petition is filed under Section 397 r/w 401 of Cr.P.C praying to set aside the judgment dated 17.01.2018 passed by the LXIII Additional City Civil and Sessions Judge, Bengaluru (CCH-64) in Criminal Appeal No.222/2017 vide Annexure-A and consequently set aside the judgment dated 02.02.2017 passed by the XX Addl. Chief Metropolitan Magistrate, Bengaluru City, in C.C.No.29428/2015 vide Annexure-B and take cognizance of the petition.
This Criminal Revision Petition coming on for Admission this day, the Court made the following:-
O R D E R Learned counsel for the petitioner-accused is absent.
2. Learned counsel for the respondent-complainant has filed a memo stating that accused has complied with the order of conviction passed by the trial Court by paying the penalty imposed on her by reporting the same before the trial Court. It is his submission that the trial Court by the order dated 2.2.2017 in CC.No.29428/2015, convicted the accused-petitioner herein for the offence punishable under Section 138 of N.I. Act and sentenced her to pay a fine of Rs.4,60,000/- with default sentence.
3. For having paid the entire amount by the accused to the complainant and the same is reported before the trial Court, which has passed the order of acquittal, the present petition has become infructuous.
With the aforesaid observations, the petition is disposed of, with liberty to the parties to revive this criminal revision petition by filing a compromise petition, if they are advised to do so.
