Heard Smt. Pooja Mishra, learned counsel for the petitioner, learned Standing Counsel, who represents the respondent nos.1 and 4 and Sri Diwakar Singh, learned counsel appeared on behalf of respondent no.5.
With the consent of learned counsel for the parties, the writ petition is disposed of.
The petitioner has prayed for issuance of mandamus directing the Up-Ziladhikari, Sadar, Allahabad, respondent no.1 to decide the pending suit being Suit No.146 of 2006 (Reshma Vs. Asia Begum and others) filed under Section 229-B of U.P. Zamindari Abolition and Land Reforms Act, 1950, expeditiously.
Having heard the learned counsel for the parties, the writ petition is disposed of by directing the respondent no.1, Up- Ziladhikari Sadar, Allahabad to decide the abovementioned suit expeditiously after providing opportunity of being heard to the respective parties in accordance with law, positively and preferably within a period of three months from the date of production of certified copy of this order is produced by the petitioner.
It is made clear that this Court has not adjudicated upon the merits of the claim of the petitioner as raised in this writ petition.
