The sole relief claimed in the instant petition is for issuance of a direction to the court below to decide Misc. Suit No.5/70/17 filed under Indian Succession Act for grant of succession certificate expeditiously.
According to the petitioner, the defendants in the said suit have been duly served and they are contesting the proceedings.
A perusal of the order sheet reveals that at present, the court is lying vacant, therefore, this Court is not inclined to issue any direction at this stage. However, as soon as a Presiding Officer is posted or case is transferred to some other court, it shall be open to the petitioner to make request for expeditious disposal of the proceedings and in which event, the concerned court, having regard to the nature of the proceedings, shall make endeavour to decide the same expeditiously.
The petition stands disposed of accordingly.
