RESPONDENTS THIS PETITION IS FILED UNDER ARTICLES 226 AND 227 OF THE CONSTITUTION OF INDIA, PRAYING TO QUASH THE ORDER DATED 15/28.01.2013 PASSED BY THE 2ND RESPONDENT VIDE ANNEXURE - V INSOFAR AS REFUSING TO EXTEND 20 YEARS TIME BOUND ADVANCEMENT AND NOT EXTENDING THE PROMOTION TO THE NEXT HIGHER CADRE i.e., FIRST DIVISION ASSISTANT; DIRECT THE RESPONDENTS TO EXTEND 20 YEARS TIME BOUND INCREMENT TO THE PETITIONER; DIRECT THE RESPONDENTS TO PROMOTE THE PETITIONER TO THE CADRE OF FIRST DIVISION ASSISTANT FROM THE CADRE OF SECOND DIVISION ASSISTANT.
THIS PETITION COMING ON FOR PRELIMINARY HEARING IN ‘B’ GROUP THIS DAY, THE COURT MADE THE FOLLOWING:
ORDER Sri Vighneshwar S. Shastri, learned advocate for the petitioner, after arguing the case for sometime submitted that this petition may be disposed of permitting the petitioner to submit a representation to respondent No.2 for consideration of the grievance with regard to the payment of 20 years time bound advancement and extension of the promotion benefit from the date the immediate junior of the petitioner was promoted. Submission of learned counsel is recorded and the petition is disposed of.
If the petitioner submits representation, the 2nd respondent shall consider the same in accordance with law and notify the petitioner the outcome of consideration within a period of eight weeks from the date the representation is received.
Ordered accordingly.
