The petitioners claim to be major having attained the age of approximately 19 and 22 years. The High School certificate of petitioner no.1 has been appended to indicate her date of birth being 16.7.2000. Learned counsel for the petitioners submitted that all the necessary documents of petitioner no.2 being proof of his date of birth are in his house and not in his custody and as such could not be produced with the writ petition. It is, however, contended that the petitioner nos.1 and 2 being major have decided to live as husband and wife.
Be that as it may, noticing the age of petitioner no.1 as is evident from the marksheet appended with the writ petition, this Court though do not find any reason for quashing of the First Information Report, but it is provided that the petitioners shall not be arrested till submission of police report under Section 173 (2) Cr.P.C in Case Crime No.195 of 2019 under Section 366 I.P.C, Police Station-Soron, District-Kashganj, however, they shall cooperate in the investigation in question.
The writ petition is, accordingly, disposed of. Order Date :- 25.6.2019 Harshita
