This application is directed against an order dated 24.11.2016 dismissing the application under Section 128 Cr.P.C. on account of the applicant's non appearance.
The Applicant may make an application seeking recall of the order dated 24.11.2016 which shall be considered in accordance with law by the Judge, Family Court bearing in mind that the purpose of an application under Section 128 Cr.P.C. is to realize the fruits of a maintenance order which should not be thwarted by dealing with it as if it were a mere money decree. In case, such an application is filed, the Family Court concerned is directed to proceed with the same and dispose it of within a period of two months from the date of receipt of a copy of this order in accordance with law.
