The petitioner in the writ claims appointment as Mukhya Sewika on the basis of Bal Vikas Avam Pushtahar Examination, Uttar Pradesh ( Group 'C' post) conducted in the year 2001.
The petitioner is a general category candidate and it is admitted that in the said category the last selected candidate had obtained 126 marks whereas the marks obtained by the petitioner is 121 in all. Therefore, she has no right to be selected.
Since the submission was that certain posts for general category had remained unfilled, the writ Court had permitted the candidates lower in merit to make representation, if unfilled vacancies are still available.
In view of the above, we do not consider that any prejudice has been caused or that the grievance of the petitioner do not stand satisfied. The petitioner may represent if so advised. If the petitioner prefers a representation, it shall be decided expeditiously as far as possible within three months.
The appeal lacks merit and is dismissed.
