Heard learned counsel for the petitioner, learned Standing Counsel for respondent nos. 1 and 2, Sri Arun Kumar, learned counsel for the respondent nos. 3 and 4 and Sri Bharat Pratap Singh, learned counsel for the respondent no. 5.
Learned counsel for the petitioner submitted that petitioner submitted online counselling application form for Assistant Teacher Recruitment Examination, 2018 in which some incorrect entries were made. He further submitted that a Circular dated 18.8.2018 was issued by respondent no. 3 which provides for correction in the same. He next submitted that for redressal of her grievance, petitioner submitted an application dated 9.3.2019 for making necessary correction which has not been decided till date. Lastly he submitted that a suitable direction may be issued to respondent no. 3 to consider and decide the application of the petitioner and carry out necessary correction.
Sri Arun Kumar, learned counsel for the respondent nos. 3 and 4 submitted that time for correction is over, but in case any application for correction is filed by petitioner, the respondent no. 3 shall consider and decide the same in accordance with law at the earliest.
Considering the facts and circumstances of the case, the writ petition is disposed of with liberty to the petitioner to move afresh application before the respondent no. 3 for correction and in case any such application is filed by petitioner, the respondent no. 3 is directed to consider and decide the same strictly in accordance with Circular including time frame fixed, if any, or any Rule provided for the same within six weeks from the date of production of certified copy of this order.
It is made clear that Court has not adjudicated the case on merits and it is upon the respondent no.3 to decide the application of the petitioner after considering the Rules, Circular and Government Order occupying the field.
