Heard learned counsel for the applicant as well as learned A.G.A. for the State of U.P and perused the material available on record.
By way of the instant application, the applicant seeks bail in Case Crime No. 437 of 2016, under Sections - 420, 467, 468, 471, 120-B I.P.C., Police Station - Sihani Gate, District - Ghaziabad.
Applicant claims to be innocent on account of fact that she being lady. She had no knowledge of the bank transaction entered into by another co-accused say Sonu Mishra. She never induced any person to deposit or withdraw money from the bank account. She has got no criminal antecedent and is languishing in jail since 28.11.2016. In case, she is admitted to bail, there is no possibility of her absconding or misusing the liberty of bail.
Per contra, learned A.G.A. has submitted that it is admittedly on record that money was transacted in the concerned bank account of the applicant to the tune of Rs.16 lakhs and the applicant owes an explanation to that and atleast to pay back the aforesaid amount in order to prove her innocence.
Considered the rival submissions and perused the material brought on record. No good ground is made out for bail.
Accordingly, the instant bail application is rejected, at this stage.
It is made clear that the observation made in this order shall not be construed to have any reflection on merit of the case.
