Petitioner's vehicle bearing registration No.KL-32/7004 has been seized alleging transportation of river sand without permit. The proceeding is pending before the second respondent. The seizure was on 29.08.2013.
2. Learned counsel for the petitioner submits that the material in the vehicle is not river sand, it is granite powder.
2. In view of the above fact, there shall be a direction to the second respondent to finalise the proceeding within a period of six weeks after affording an opportunity of hearing to the petitioner. The second respondent shall take sample of the material from the vehicle, send the same for analysis and obtain a report from the analyst regarding the nature of the substance. Based on the report, proceedings shall be concluded by the second respondent.
The Writ Petition is disposed of as above.
