JUDGMENT / ORDER

Petitioners were appointed as Cook from the list sponsored by the Employment Exchange for employment with the third respondent. The petitioners submit that the original discharge certificates issued by the third respondent are misplaced. The petitioners have approached the Employment Exchange for the purpose of entering the discharge in the register maintained in the office. However, the petitioners were directed to produce original or duplicate certificates from the third respondent. The petitioners have approached the third respondent. They refused to issue discharge certificates. Accordingly, the petitioners have approached this Court.
If the petitioners have misplaced the original discharge certificates, necessarily, the employer is bound to issue a W.P.(C) No.29254 of 2014 2 duplicate certificate after obtaining necessary requisite fee, if any, payable. Therefore, the petitioner shall file an affidavit before the third respondent stating that these original certificates were lost irrecoverably and make a request for issuing discharge certificates. The affidavit shall be attested by the notary. Based on such affidavit, the third respondent shall issue discharge certificates within a period of one week from the date of receipt of a copy of this judgment. On production of duplicate discharge certificates, 5th and 6th respondents shall enter necessary details in the register maintained regarding discharge without any delay.
The writ petition is disposed of as above.
