Heard learned counsel for the applicant, learned AGA for the State and perused the record.
This application under Section 482 CrPC has been filed by the applicant with a prayer to direct the learned Additional Principal Judge, Family Court (First), Maharajganj to decide the Case No. 1149 of 2019 (Rekha Vs. Sudama), under Section 125 CrPC, Police Station Kothibhar, District Maharajganj within stipulated period.
Learned counsel for the applicant has submitted that in the present case, applicant is the wife and she has filed an application under Section 125 CrPC on 02.05.2015, however since then, proceeding has been lingering-on, on one pretext or the other.
In view of the above, learned court below is directed to make all endeavours to decide the aforesaid application as expeditiously as possible, preferably within a period of three months from the date of filing of certified copy of this order without giving any unnecessary adjournments to either parties, if there is no other legal impediment in deciding the aforesaid application.
With the aforesaid direction, this application under Section 482 CrPC is finally disposed of.
