List of fresh cases is revised. None is present to press the present petition.
Pursuant to the order dated 18.12.2018, learned Standing counsel has received instructions dated 29.12.2018. The same is taken on record .
The present petition has been filed seeking quashing the impugned order dated 12.04. 2018 with all consequential effects passed by the District Magistrate, Bijnor so far as the transfer of the election petition No. 1668 of 2016 (Computerized Case No. T20161316031668) (Poonam Vs. Rekha Rani and others) from the Court of Sub Divisional Magistrate, Dhampur to Additional Magistrate-II, Bijnor and also quash the impugned order dated 16.10.2018 with its all consequential effects passed by Additional Magistrate-II, Bijnor, (Annexure No. 2 and 3 to the writ petition).
Paragraph 5 of the instructions clearly indicats that the Additional Magistrate is also of the cadre of the Deputy Collector which post is said to be equivalent to the post of Regional magistrate.
In view of the above, I do not find any illegality in the impugned order.
The petition is, accordingly, dismissed.
Learned Standing Counsel is directed to communicate this order to the Court concerned within a week.
