JUDGMENT / ORDER

The petitioner is the holder of building permit for constructing residential building by Ext.P2. The petitioner wants to transport ordinary earth from the land for the purpose of construction. In view of the building permit it is not necessary to obtain permission from Geologist for extracting ordinary sand from the site. However, for transporting ordinary sand 'P-Form' is necessary. It is seen from Ext.P3 Government Order that no licence or permit is required for extracting ordinary earth for the purpose of construction of residential buildings. 2. Therefore, there shall be a direction to the District Geologist to issue necessary 'P-Form' to the petitioner on being satisfied with the genuineness of the claim raised by the petitioner based on Ext.P2 building permit without insisting No Objection Certificate. This shall be done within a period of ten days from the date of receipt of a copy of this judgment.
The writ petition is disposed of as above.
