Interim relief in terms of Para-8(C) on condition that the petitioner-University will deposit the entire amount, as directed by the Tribunal in its impugned order dated 15.09.2011, with the Registry of this Court within a period of Two Weeks from today, after deducting any amount that is to be required to be recovered from respondent no.1, from such amount of deposit.
However, before effecting any recovery, the petitioner-University shall provide the calculation thereof to learned counsel for respondent no.1. It is, however, clarified that with-holding of such amount of recovery shall be out of the amount of back-wages only and not out of the retirement dues, which, otherwise, respondent no.1 is entitled to receive.
