Petitioner has filed Exts.P2 and P2(a) appeals against Ext.P1 and P1(a) assessment orders. He has also filed Exts.P4 and P4(a) stay petitions along with Exts.P3 and P3(a) applications to condone the delay. In the meantime, the petitioner is faced with Exts.P5 and P5(a) demand notices pursuant to the orders passed in terms of Exts.P1 and P1(a) orders.
2. Heard the learned Government Pleader.
3. It is submitted by the learned counsel for the petitioner that if, during the pendency of the appeals, recovery is made, he will be put to irreparable loss.
4. Having regard to the aforesaid submission, I am of the view that this writ petition can be disposed of directing the appellate authority to dispose of the stay petitions along with the delay petitions within a time frame.
Accordingly, this writ petition is disposed of as under:
i) 2nd respondent shall consider Ext.P4 and P4(a) stay petitions along with Exts.P3 and P3(a) petitions to condone the delay within a period of one month from the date of receipt of a copy of this judgment.
ii) Until such time, the demand made in terms with Exts.P5 and P5(a) notices shall be kept in abeyance.
