Heard the learned counsel for the petitioner, Sri Vikas Budhwar, learned counsel for the respondents and perused the record.
The instant writ petition has been filed seeking following relief:
"(i) to issue a writ, order or direction in the nature of certiorari quashing the impugned order dated 15.10.2020 passed by the respondent no. 2 (Annexure No. 1 to the writ petition).
(ii) to issue a writ, order or direction in the nature of mandamus directing the respondent no. 2 to carry out the field verification of credentials on the subject location in which the petitioner was selected as provided in the brochure (guidelines dated 24.11.2018).
iv) Issue any other writ, order or direction in the like nature which this Hon'ble Court may deem fit and proper in the circumstances of the case.
(iv) Award the costs of the writ petition to the petitioner."
Learned counsel for the petitioner submits that the petitioner has applied for retail outlet in other backward class category rural type in which she was declared as successful candidate by letter dated 23.1.2020. In pursuance of which she had deposited the security money as demanded to the tune of Rs. 30,000/-. It is further submitted that the petitioner has also submitted the required documents but the respondent has cancelled her application by the impugned order dated 15.10.2020.
Sri Vikas Budhwar, learned counsel for the respondents submits that as the required documents with respect to the claim of ownership of the land has not been filed, hence the application for retail outlet was rejected. However, the petitioner has an alternative remedy to raise her grievance before the respondent no. 1 under Clause 18 of the Selection Guidelines.
Having considered the submissions of the learned counsel for the parties and without entering into the merits of the case, we dispose of this writ petition with the direction to the respondent no.1 that in case the petitioner moves an application before him within two weeks the same shall be decided within a period of four weeks therefrom in accordance with law after giving due opportunity of hearing to the petitioner.
