The applicant is before this Court for a direction to initiate contempt proceeding against the opposite party for wilful disobedience of the order dated 18.09.2020 passed in Writ A No.7286 of 2020 (Smt. Reeta Singh Vs. State of U.P. and 4 Others). The order is reproduced hereinbelow:-
"Petitioner's claim for grant of family pension has already been recommended by the Superintendent of Police, Basti on 5.3.2019 to the Finance Controller but a final decision is still awaited and hence, petitioner is before this Court.
Learned Standing Counsel states that an appropriate decision would be taken by the authority competent, in accordance with law.
In that view of the matter, this writ petition stands disposed of with a direction upon respondent no.4 to take an appropriate final decision upon the recommendation made by Superintendent of Police, Basti, dated 5.3.2019, within a period of two months from the date of presentation of a copy of this order.
The concerned Authority/Official shall verify the authenticity of computerized copy of this order from the official website of High Court Allahabad and shall act accordingly without waiting for submission of the certified copy of this order."
Today when the matter is taken up, it is informed by learned counsel for the applicant that the order passed by the writ court has already been complied with, therefore, no cause of action remained survive and prays that the present application be dismissed as infructuous.
In view of the same, the present contempt application is dismissed as infructuous.
