Heard Sri Madan Mohan learned counsel for the petitioners and learned Standing Counsel.
The petitioners' claimed possession of house municipal No.318, Mohalla-Balli Ka Adda, Ward No.3, Mussaffarganj, Mirzapur. They want that their possession over the said house may not be disturbed and that their representation dated 06.12.2019 to the District Magistrate be directed to be decided within a time bound period.
It appears that there is dispute in relation to the said house between the petitioners and the private respondents in regard to which a civil suit is already pending.
The contention is that the police officials have no authority in law to interfere in the said private dispute and to visit the house so as to get it vacated from the petitioners.
In view of the aforesaid facts and circumstances, we dispose of the writ petition with liberty to the petitioners to submit a comprehensive representation ventilating their grievances before the District Magistrate within a period of two weeks from today.
In case any such representation is moved, the District Magistrate shall consider it in the light of the government orders dated 16.05.2012, 09.05.2014 and 16.09.2015 and pass appropriate orders thereon if necessary ensuring protection of the petitioners from dispossession from the house in question.
Accordingly, the Writ Petition is disposed of.
