Heard Sri R.K. Upadhaya, learned counsel for the petitioner, T.M. Khan, learned counsel for the respondent-Gaon Sabha and Sri Abhishek Shukla, learned Standing Counsel for the State- respondents.
In view of the order proposed to be passed, notice need not go to respondent nos. 3 and 4.
Petitioner before this Court seeks a writ of mandamus directing respondent no.2 (Commissioner, Gorakhpur Division, Gorakhpur to decide Revision No. C20170500887 of 2017 (Reeta Devi vs. Parashuram) under Section 219 of the Land Revenue Act, 1901 within stipulated period as may be fixed by the Court.
The record in question reflects that proceedings under Section 33/39 of the U.P. Land Revenue Act has been finalized against the petitioner by the Sub-Divisional Magistrate, Salempur, District Deoria vide order dated 31st May, 2013. The said order has been assailed by the petitioner by filing the aforesaid revision, which is still pending since 2017. As such a request has been made by the petitioner that the said revision may be directed to be decided expeditiously.
Considering the facts and circumstances of the case, without expressing any opinion on the merits of the aforesaid and with the consent, the present writ petition is disposed of finally with a direction upon respondent no. 2 to consider and decide the aforesaid revision in accordance with law, expeditiously and preferably within a period of six months from the date of production of certified copy of this order but certainly after giving opportunity to the parties concerned and without granting unnecessary adjournments to either of the parties, except upon payment of cost of Rs. 2000/-.
