Supplementary affidavit filed today is taken on record.
This writ petition has been filed, seeking protection of life and liberty of the petitioners. The petitioner no. 1, Smt. Reeta Chauhan has claimed to be major. However, there is no documentary evidence in support of such claim. It has also been stated in the writ petition that such evidence is not in her possession.
Accordingly, it is provided that the petitioner no. 1 shall present herself before the Chief Medical Officer, Ballia on 15.6.2018. The Chief Medical Officer, Ballia under the medical procedures prescribed, ascertain the age of petitioner no.1 Smt. Reeta Chauhan. He shall submit a report to learned Standing Counsel in sealed cover by 30.6.2018.
Put up as fresh on 17.7.2018.
Let a copy of this order be provided to learned counsel for the petitioners during the course of the day on payment of usual charges.
It is agreed between the parties that neither will offer any resistance to full implementation of this Court order. Any obstructionist or adverse action on part of either party may invite action for contempt of Court.
It is further made clear that the petitioners have been directed to produce themselves before the Chief Medical Officer, Ballia for the purposes of the test as directed above. Since the matter is pending before the Court and the test is to be done in compliance of the order passed by this Court, the respondent State authorities may ensure that the petitioners liberty is not curtailed in the meanwhile.
Copy of this order may be supplied to the learned Standing counsel free of cost for due compliance by all authorities.
