Heard Sri Ashwini Kumar Srivastava, learned counsel for the petitioner and Ms. Sushma Soni, learned A.G.A. for the State respondents.
Learned A.G.A. submits that the instructions have been received to the effect that the petitioner-Reeshu, due to some differences with her husband, had gone away to her parental home and that she does not want to return back to her matrimonial home.
In view of the aforestated factual position, she submits that in case the husband has any grievance with regard to her wife not coming back to her matrimonial home, the appropriate remedy would be to approach the appropriate forum for the claim regarding restitution of conjugal rights.
Learned counsel for the petitioner has not been able to dispute the aforesaid factual and legal position.
Having regard to the aforesaid, this Court is not inclined to entertain the petition seeking a writ of habeas corpus.
Petition stands dismissed, accordingly.
