Heard Sri Parbind Kumar Tiwari, counsel for the petitioners, Sri Shailendra Kumar Verma, counsel for respondent no. 4 and learned A.G.A. for the State of U.P.
This petition has been filed with a prayer to stay the arrest of the petitioners in the F.I.R. dated 10.07.2018, registered as Case Crime No. 0129 of 2018, under Sections 363, 366 and 323 of IPC, Police Station - Adampur, District - Varanasi.
Reena, petitioner no. 1 appears in the Court and states that she has voluntarily married to Gopal Kewat, petitioner no. 2. In support of her age proof, a copy of her high school mark-sheet has been filed as Annexure No. 2, wherein her date of birth is mentioned as 20.07.2000, as such she is major today.
Considering the submissions advanced by counsel for the parties and nature of the allegations, it is directed that the petitioners shall not be arrested in above mentioned case, till the submission of the police report under section 173(2) of Cr.P.C., but shall co-operate with the investigation of the case.
With the aforesaid directions, this petition is finally disposed of.
