This petition has been filed by the petitioner praying for a direction to the respondent no. 3 - Judge Small Causes Court / Additional Civil Judge (Senior Division), Ghaziabad to decide the SCC Case No. 31 of 2014 (Reena Vs. Shyoraj & another) pending before him for the past four years as expeditiously as possible .
The counsel for the petitioner submits that Small Causes cases are summary proceedings and should preferably be decided within six months of their filing. However four years have passed, but the said case is still pending and there is no likelihood of it being decided in the near future unless this Court issues a direction to the respondent no. 3 to decide the same.
A perusal of the pleadings on record show that affidavits have been exchanged between the parties and pleadings are complete and evidence of the plaintiff has also been taken, but the matter is being delayed due to delaying tactics of the respondent / tenant.
Accordingly, this petition is disposed of with a direction to the respondent no. 3 to decide the SCC Suit pending before him as expeditiously as possible say within a period of eight months from the date a certified copy of this order is produced before him.
