This writ petition has been filed, inter alia, for the following relief:
"(a) Issue a writ,order or direction in the nature of mandamus directing respondent No.2 to carve out or to construct the connecting road/approach road through the green belt for the purposes of exit and entry of plot no.63 having area of 4000, in sector Ecotec- 1,Extension-1, Greater Noida, Gautam Budh Nagar, or in the alternative be pleased to pass suitable orders directing respondent No.2 to give an alternative plot in a developed sector for the purposes of stating up the industrial unit at the earliest."
Learned counsel for the petitioner has confined his prayer to the extent that the petitioner may be permitted to make a fresh representation before the concerned authority in respect of his grievances with a direction to the concerned authority to decide the same within a stipulated period.
Heard learned counsel for the parties and perused the record Considering the facts and circumstances of the case, without expressing any opinion on the merits of the case, this writ petition is finally disposed of with a direction to the petitioner to make a fresh representation before the Respondent No.2, The Chief Executive Officer, Greater Noida Industrial Development Authority, Gautambudh Nagar ventilating his grievances within three weeks from today along with a certified copy of this order enclosing therewith a copy of the writ petition and its entire Annexures and, if any such representation is made, the said authority or any other senior officer as authorised by the respondent no.2 shall make all endeavours to consider and decide the same by a reasoned and speaking order in accordance with law expeditiously preferably within six weeks from the date of receipt of the said representation after hearing the petitioner.
It is open for the petitioner to adduce any cogent evidence, if any, in support of his contention and take all legal pleas as permissible in law.
In case, the petitioner does not file the representation within the stipulated period before the concerned authority within the stipulated period , the benefit granted to the petitioner in this order shall cease to operate.
