Heard Sri Shyam Shanker Pandey, learned counsel for the applicant and Sri G. P. Singh, learned A.G.A. for the State.
This application has been filed with a prayer to expedite the Case no. 1305 of 2016 (State of U.P. Vs. Mantosh) in Case Crime no. 445 of 2015, under Section 376, 354-A, 323, 506 I.P.C., Police Station Indrapuram, District Ghaziabad, pending in the court of Fast Track Court, Court No. 1, Ghaziabad.
It has been argued by the learned counsel for the applicant that the applicant is informant of this case. The charge-sheet has beensubmitted in this case in the year 2016 but till date the trial court has been able to record only one witness i.e. P.W. 1 and, therefore, a direction is sought to be issued to the trial court for expeditious disposal of this case.
Learned A.G.A. has no objection if such kind of direction is issued.
Perused the certified copy of the order-sheet of the trial court which has also been annexed.
The order sheet shows that only one statement of P.W. 1 has been recorded in so many years, therefore, it is directed that court below shall make all endeavour to decide this case expeditiously preferably within a period of six months from today, if there is no legal hurdle, without permitting undue adjournments to either sides.
With aforesaid direction, this Application under Section 482 Cr.P.C. is finally disposed of.
