JUDGMENT / ORDER

[1.0] RULE.
Shri L.B.
Dabhi, learned Additional Public Prosecutor waives service of notice of Rule on behalf of respondent No.1.
Though a copy is served upon learned advocate appearing on behalf of respondent No.2, the learned advocate appearing on behalf of respondent No.2 has chosen to remain absent. In the facts and circumstances of the case and with the consent of learned advocates appearing for respective parties, present application is taken up for final hearing today.
[2.0] Present application has been preferred by the applicant herein - original petitioner for permitting the applicant to amend the prayer clause of Criminal Miscellaneous Application No.13032/2007 as prayed for.
[3.0] Having heard Shri Dhaval Vyas, learned advocate appearing on behalf of the applicant and Shri L.B. Dabhi, learned Additional Public Prosecutor appearing on behalf of the State and considering the averments in the application and even the averments in the main application, present application is allowed and applicant is permitted to amend the prayer clause as prayed for. Applicant to carry out the amendment by 15th February 2012. Rule is made absolute accordingly.
Main Criminal Miscellaneous Application No.13032/2007 is adjourned to 22nd February 2012.
