Heard learned counsel for the petitioners and learned Standing Counsel for the State.
It is stated that both petitioners have solemnized their marriage out of their own free will. They have filed their AADHAR Card and photographs of their marriage.
It is alleged that the private respondents are interfering with marital life and liberty of the petitioners. Hence, they moved an application before the police authority on 23.7.2018.
Learned Standing Counsel for the State states that one of the petitioners are minor.
This Court has not gone into the validity of the marriage or the minority or majority of the petitioner as the same has to be decided by the appropriate court and, hence, the submission of the learned Standing Counsel is not accepted.
The police authority, may give protection to the petitioners in view of the decisions of Apex Court in Gian Devi v. The Superintendent, Nari Niketan, Delhi and others, (1976) 3 SCC 234; Lata Singh v. State of U.P. and another, (2006) 5 SCC 475; and Bhagwan Dass v.
State (NCT of Delhi), (2011) 6 SCC 396.
With these observations, this petition is disposed of.
