Petition under Section 438 of CR.P.C., praying that in the circumstances stated in the petition and the grounds filed herein, the High Court may be pleased to enlarge the petitioners/Accused Nos. 1 & 2 on bail in Crime NO 881 of 2013 on the file of Kancharapalem Police Station in Visakhapatnam District, pending enquiry and trial.
The petition coming on for hearing, upon perusing the petition and the grounds filed herein, and upon hearing the arguments of Sri Mavidi Rama Rao, Advocate for the Petitioners and of the Public Prosecutor on behalf of Respondent- State, the Court made the following.
ORDER:-
“The petitioners are A1 and A2. They seek for grant of anticipatory bail. The first petitioner is working in the steel plant at Visakhapatnam. The second petitioner is working as a School Assistant in ZP High School. The second petitioner is the wife of the first petitioner. They allegedly committed an offence under Section 420 and 177 read with Section 34 IPC by procuring a false birth certificate for their son. In view of the nature of the offence alleged and in view of the calling of the petitioners, I consider it appropriate to enlarge the petitioners on anticipatory bail.
Hence, this Petition is allowed. The petitioners shall surrender before the III Metropolitan Magistrate, Visakhapatnam, Visakhapatnam District, within two weeks from today. On such surrender, the learned III Metropolitan Magistrate, Visakhapatnam, shall enlarge the petitioners on bail on a bond of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties each in a like sum to his satisfaction.”
