ORDER:
This writ petition is filed for a Mandamus to set aside proceedings in Lr.No.1043/EE/2011 dated 30.11.2013 of respondent No.2, whereby he has fixed 09.12.2013 as the date for holding skill test for considering admission of members into respondent No.4 society.
A perusal of the impugned proceedings shows that the same was issued in pursuance of order dated 20.08.2013 in W.P.Nos.37511 and 37162 of 2013. By the said order, this Court held that having regard to the water spread area, the membership of respondent No.4 society shall be standardised at 370 once for all, that depending upon the membership, a skill test has to be held either to expel the members if the number is more than 370 and admit new members if there is shortfall in the membership below 370. In the impugned proceedings, it is stated that 114 vacancies are in existence and that new members have to be admitted subject to their qualification in the skill test. In the light of these facts, this Court does not find any illegality in the impugned proceedings. Unless the petitioners pass the skill test, they cannot aspire to become the members of respondent No.4 society.
Learned counsel for the petitioners stated that her clients have no objection for participating in the skill test.
The learned Assistant Government Pleader for Fisheries stated that in pursuance of the interim order passed by this Court, skill test has already been conducted.
In the above facts and circumstances of the case, the writ petition is disposed of with the direction to respondent No.2 to complete the selection of the persons including the petitioners, who have attended the skill test, and issue appropriate proceedings on the admission of the members against the existing vacancies in respondent No.4 society, strictly considering the merits of each candidate, within two months from the date of receipt of this order.
As a sequel to the disposal of the writ petition, W.P.M.P.No.44096 of 2013, W.P.M.P.No.43530 of 2014, W.V.M.P.No.3458 of 2014 and W.V.M.P.No.3649 of 2014 shall stand disposed of as infructuous.
