The petitioner was leased out a shop for a period of one year commencing from 1st July 2018 and ending on 30th June 2019 under a deed of license dated 1st July 2018 executed between the President of India and and the petitioner.
By the impugned order dated 22nd April 2019 Lieutenant Colonel has directed the petitioner to vacate the shop by 30th April 2019 as per the oral direction of the Station Commander New Cantt., Allahabad.
The submission is that there is no order revoking the license of the petitioner by the President of India and that simply on oral directions the petitioner can not be asked to vacate the shop that too prior to the expiry of the period of license.
Learned counsel appearing for the respondents may seek instructions and file counter affidavit within a month. Two weeks thereafter are allowed to the petitioner for filing rejoinder affidavit.
Till the expiry of the period of license as per the aforesaid agreement the petitioner shall not be dispossessed from the shop in dispute provided petitioner continues to pay the license fee in accordance with law.
