HON'BLE SRI JUSTICE C.V.NAGARJUNA REDDY COMPANY PETITION No.13 of 2013 ORDER:
This Company Petition is filed for an order to wind up the respondent for non-payment of the admitted debt due to the petitioner.
At the hearing, Sri T.Ramesh Babu, the learned counsel representing Sri Srinivas Rao Bodduluri, the learned counsel for the respondent, submitted that out of the sum of Rs.21,85,455/- claimed by the petitioner, the respondent has earlier paid Rs.15 lakhs; that for the balance amount, four post dated cheques, dated 27.06.2014, 15.07.2014, 28.07.2014 and 14.08.2014 have been issued by the respondent; that the first post dated cheque which fell due on 27.06.2014 for Rs.1.80 lakhs was encashed by the petitioner; and that the respondent will ensure that the remaining three post dated cheques will be duly honoured on their due dates.
The above submissions of the learned counsel for the respondent have not been disputed by the learned counsel for the petitioner.
In the light of the fact that the respondent has discharged a substantial part of the debt and also committed itself for discharging the balance debt by issuing three post dated cheques, the Company Petition is closed, however, with liberty to the petitioner to seek revival of the Company Petition in the event any or all of the post dated cheques is/are not honoured.
