R.Chitra vs The Director Of Elementary ...

Madras High Court|22 March, 2017

JUDGMENT / ORDER

Mr.P.Sanjay Gandhi, learned Additional Government Pleader takes notice on behalf of the respondents 1 and 2.
2.The petitioner filed the present writ petition seeking for a writ of mandamus to direct the 2nd respondent to promote the petitioner to the post of BT Tamil Pandit, Middle School, Valavanur (West), Koliyanur Union, Villupuram District, by considering the representation dated 10.10.2016 & 09.03.2017.
3.The petitioner claims to be the senior most person in the seniority list for the post of BT Tamil Pandit as per the seniority list published on 01.01.2016. The petitioner, who has completed B.Lit., M.Ed., had joined the services of the respondent as Secondary Grade Teacher on 25.01.1990. After a long period of service, she was promoted to the post of Primary School Head Master on 25.10.2005, and till now, she has been working as Primary School Head Master at Primary School, V.Thotti, Koliyanur Union, Villupuram District. While so, it is the grievance of the petitioner that she is the senior most person to be considered for promotional post of Tamil Pandit, as per the seniority list drawn on 01.01.2016.
4.In the mean while, the post of BT Tamil Pandit fell vacant from 06.08.2016 at Middle School, Valavanur (West), Koliyanur Union, Villupuram District, for which, the 2nd respondent deployed one Thilagam from Melmalaiyanur Union on 06.08.2016 for the post of BT. Tamil Pandit. However, the said Thilagam is not willing to join at Valavanur.
5. Therefore, the grievance of the petitioner is that the 2nd respondent ought to have promoted the petitioner to the said post however, for the reasons best known to him, he has not done so. Subsequently, she was called for to attend the counselling held on 09.03.2017 and accordingly, she has also appeared. It is further stated that on the same day, she has also made a representation to the 2nd respondent to consider her for the promotional post, as she is the senior most person. However, neither the 2nd respondent considered his representation nor has given any promotion pursuant to the counselling held on 09.03.2017.
