Heard Sri Mahendra Pratap Singh, learned Standing Counsel, on behalf of State-respondents.
The prayer made in the instant petition is for issuing direction to the trial court to decide application under Order 7 Rule 11 CPC filed by the petitioners challenging the jurisdiction of the Court in Original Suit No. 213 of 2016 within a specified time frame.It is also prayed that the suit itself be directed to be decided expeditiously.
The petitioners are defendants 2 and 3 in the suit. According to them, the suit is not maintainable. They had filed an application under Order 7 Rule 11 CPC which has not been decided by the trial court so far.
Accordingly, the instant petition is disposed of with direction to the trial court to ensure that the application filed under Order 7 Rule 11 CPC is taken up for consideration and decided in accordance with law, by fixing short dates and without granting unnecessary adjournments.
