R.Baskaran vs Special Assistant Collector

Madras High Court|08 June, 2009

JUDGMENT / ORDER

This writ petition has been filed by the petitioner praying for a direction to the first respondent to appoint the petitioner in a suitable post on compassionate grounds.
2. The main contention raised by the learned counsel for the petitioner is that the petitioner is eligible to be appointed on compassionate grounds in view of G.O.Ms.134, Labour and Employment (Q,1)Department, dated 22.10.1998.
3. In the reply affidavit filed on behalf of the respondents, it has been clearly stated that G.O.Ms.No.134, Labour and Employment(Q1) Department, dated 22.10.1998, would be applicable only if the death of the Government Servant had occurred on or after the date of issuance of the above said Government Order.
4. In the present case, the sister of the petitioner, Selvi R.Bharathi had expired on 07.05.1997, prior to the issuance of the said Government order and hence, the said Government order is not applicable to the petitioner. Therefore, this Court feels that the petitioner has not made out sufficient grounds to grant the reliefs as prayed for by the petitioner. Hence, the Writ Petition stands dismissed. No costs.
