Heard learned counsel for the parties.
This application has been filed praying for transfer of the case no. 63 of 2016 arising out of case no. 63 of 2016 (State of U.P. Vs. Shamim and others) under sections 147, 323, 406, 452, 506 I.P.C. P.s. Moudha District Hamirpur.
Parties have agreed that trial may be transferred to third place i.e., Banda,in view of the fact that at district Banda none of the parties are residing.
This application is finally disposed of with the direction to the District and Sessions Judge, Hamirpur to transfer the aforesaid case to the District Banda.The District and Sessions Judge, Banda is directed to assign the aforesaid case to the appropriate court.
