Heard learned counsel for the petitioners and learned A.G.A.
This petition has been filed by the petitioners Razi Ullah & Anr. with a prayer to quash the FIR of case crime No. 40 of 2014 under sections 363, 366-A IPC, P.S. Gaura Chauraha, District Balrampur.
From the perusal of the FIR it appears that on the basis of allegation made therein the prima facie cognizable offence is made out. There is no scope of interfering in the FIR. Therefore, the prayer for quashing the FIR is refused.
However, considering the statement of the victim recorded under section 164 Cr.P.C. by which she has not supported the prosecution story, it is directed that till the submission of the police report under section 173(2) Cr.P.C. the petitioners shall not be arrested, but the petitioners shall cooperate with the investigation.
With this direction, this petition is finally disposed of.
