Case called out. None is present on behalf of the petitioner.
The petitioner is the plaintiff in the suit and has come up before this Court claiming following relief as substantial relief:
"(i). Issue a writ, order or direction in the nature of mandamus commanding the respondents to direct the concerned court to decide the civil suit dated 09.01.2019 bearing No.- 16 of 2019 (Raza Hussain vs. Dilshad Ahmad & others) pending before the Civil Judge (Senior Division), Moradabad."
Upon perusal of the documents brought on record, I find that the suit is of the year 2019 and it is a widely known fact that the State Uttar Pradesh was badly hit initially by the lockdown during the first wave of pandemic Covid-19 and so also subsequently during the 2nd wave of Covid-19 adversely affecting the judicial functions of the courts in the State.
In such above view of the matter, therefore, this Court does not find it feasible to expedite the suit of the year 2019. However, it is expected that the court concerned shall expeditiously dispose of the suit in accordance with law.
The petition is disposed of with the aforesaid observations and directions.
