(Per : HONOURABLE MR.JUSTICE RAVI R.TRIPATHI) The present application is filed by the convict through jail seeking temporary bail for a period of 30 days so as to complete repairing work of his residential premises.
Learned APP was granted time to take instructions in the matter and to verify about stage at which the house of the convict exists. Learned APP was granted again time to take instructions and verify the contents of the application.
Taking into consideration the contents of the application, the matter requires consideration. Hence, Rule. Learned APP, Mr.Patel, waives service of rule on behalf of respondent-State.
Learned APP Mr.Patel invited attention of the Court to jail remarks.
The convict is undergoing life imprisonment for offence under Sections 302, 307, 324, 143, 147, 149 of Indian Penal Code in Sessions Case No.27 of 2002; wherein, he was convicted by judgment and order dated 27.2.2008.
He was arrested on 17.6.2001.
By now, he has undergone, 10 years, 6 months and 22 days as on 18.5.2012.
He has enjoyed temporary bail on 2 different occasions and has enjoyed furloughs on 5 different occasions and every time, he reported in time.
Nothing adverse is noticed from the jail record.
For the contents of the application, the application is allowed. The convict is ordered to be released on temporary bail for a period of 30 days from the date of his release on his executing a personal bond of Rs.5,000/- (Rupees Five Thousand Only) to the satisfaction of the Jail authorities.
The convict shall surrender himself to the Jail authorities on expiry of the above temporary bail period. The application is allowed. Rule is made absolute.
