1. Heard Sri Dileep Kumar, learned Senior Advocate assisted by Sri Manish Singh and Sri Vikas Chandra Srivastava, learned counsel for the applicant; Sri Anoop Trivedi, learned Senior Advocate assisted by Sri Harikesh Kumar Gupta, learned counsel for the opposite party no.2 and learned AGA for the State.
2. Undisputedly, at present, investigation is still pending against the present applicant though a charge sheet and two supplementary charge sheets have already been submitted against other accused persons and that matter is stated to have been committed to the Court of Session.
3. Nevertheless since at present, investigation against the applicant is pending and non-bailable warrant has apparently been issued to proceed further in accordance with law, in view of the Full Bench decision of this Court in Ram Lal Yadav & Ors. Vs. State of U.P. through D.M. Varanasi & Ors. passed in Criminal Misc. Application No.5939 of 1988 & connected matters decided on 01.02.1989, the present application is being dismissed as not maintainable, leaving open to the applicant to seek such remedies as are otherwise available.
4. Certified copy of the impugned orders etc. may be returned to the learned counsel for the applicant within next 48 hours.
