Heard Sri Dwijendra Prasad, learned counsel for the petitioner, Sri Brij Kumar Yadav holding brief of Sri Ashish Kumar Srivastava, learned counsel for the respondent no.5 and the learned Standing Counsel for the State-Respondents no.1 to 4.
The petitioner in the writ petition is seeking a direction to the respondents to remove illegal encroachment of respondents no.6 to 24 from Araji No.872, area 46.881 hectare and Araji No.877 Ka, area 2.857 hectare situated in village Nagla Ghani, Mauza Panwah, Post Jakhauwa, Tehsil Kuraoli, District Mainpuri.
However, the Tehsildar, who is the competent authority to initiate proceedings under 67 of the U.P. Revenue Code, 2006 has not been impleaded in the writ petition.
The writ petition is, therefore, dismissed with liberty to the petitioner to file a fresh writ petition impleading the necessary parties.
