Heard learned counsel for the petitioner and Shri B.P.Singh Kachhawah, learned counsel for the State-respondents.
At present, recoveries of Rs. 1,01,03,253/- are being sought from the petitioner for short supply of rice against paddy supplied to the petitioner.
At the outset, learned counsel for the petitioner states that the petitioner does not wish to contest to quantification of the recoveries being sought from it. Petitioner is willing to deposit the entire amount of Rs. 1,01,03,253/-.
While no quantity of rice or paddy may be allowed to be released unconditionally, in view of the statement made by learned counsel for the petitioner, the present writ petition is disposed of with the following directions:
(i) The petitioner shall deposit a sum of Rs. 51,03,253/- on or before 30 November 2021.
(ii) The balance amount of Rs. 50,00,000/- may be deposited by the petitioner, by way of last installment, on or before 31 December 2021.
Subject to the petitioner complying the terms of this order, no coercive measure shall be adopted against the petitioner pursuant to the outstanding recovery.
Any amount that may have been deposited by the petitioner pursuant to the impugned demand notice may be adjusted against the deposit to be made under this order.
In case of default of any of the conditions as mentioned above, the present order shall stand automatically vacated and recovery proceedings shall revive from that stage.
