Heard learned counsel for the petitioner and learned standing counsel for the State.
The present petition has been filed seeking the following relief:-
"Issue a writ, order or direction in the nature of mandamus commanding the opposite parties, particularly opposite party no.3 to consider and take appropriate decision on the application of petitioner for grant of road permit in relation to Vehicle No.U.P.13- T-4929 (Bus) Chesis No. MAT 454063C7C12195 which has been pending before the respondent for consideration since 7.8.2018 within a time frame as stipulated by this Hon'ble Court."
The petitioner alleges that the petitioner is the owner of vehicle No.U.P.13-T-4929 (Bus) Chesis No. MAT 454063C7C12195 and has applied for grant of road permit for running the said vehicle from Kanpur-Nagar to Jhinjhak vide application dated 7.8.2018 before the respondent no.3. It is further stated that the respondents- authorities have inspected the relevant document as well as the physical verification of the vehicle which has been done. The petitioner has also deposited the requisite fee however, despite completing all the formalities, no decision has been taken by the respondent no.3 in respect to the application filed by the petitioner for grant of permit.
Considering the averments made by the petitioner in the writ petition, we deem it proper to direct the respondent no.3 to take a decision with regard to the application filed by the petitioner for grant of permit in accordance with law, expeditiously preferably within a period of two months from the date of production of certified copy of this order.
We have not expressed our opinion on the merits of the claim of the petitioner and the respondent no.3 is directed to take a decision independently and in accordance with law within the time granted.
The writ petition is disposed off in terms of the said directions.
