Heard Sri Rajneesh Pratap Singh, learned counsel for the petitioner and Shri Kant Shukla, learned counsel for the respondent Nos. 3 & 4 and perused the record.
While entertaining this writ petition at the instance of the petitioner, who though has not been one of the applicants against the notice inviting tender and yet raised the issue of a person being given contract in spite of being black listed, we directed the learned counsel for the respondents to have instructions in the matter under our order dated 4th November, 2019.
Today, learned counsel for the respondents has placed instructions before us which are taken on record.
In the instructions we find that there are parawise notings and in paragraph 16 it has been stated that Committee verifying the tender application could not have knowledge about the firm being black listed as it was cancelled so that firm got selected and accordingly, on 15th October, 2019, the Managing Director issued a letter to the Officer-in-charge of the District- Hathras to take an appropriate action in the matter in respect of the firm to whom the tender was awarded.
In such view of the matter, since the respondents have already proceeded against the firm as a direction has come to be issued by Managing Director in his letter dated 15th October, 2019, it is expected that appropriate action shall be taken by the concerned respondent.
Needless to say that before the respondents proceed to take any action adverse to the firm which is already awarded contract under the tender and is carrying work, shall be given proper opportunity of hearing.
With the above observations, the writ petition is consigned to record.
