By order dated 09.03.2018 in Writ A No. 7445 of 2018 filed by the applicant, this Court directed District Basic Education Officer, Gorakhpur to redress the grievance of the applicant in accordance with law after receiving necessary instructions from the Secretary, Basic Shiksha Parishad, Allahabad. Decision was to be taken within period of three months from the date of production of a certified copy of the order.
Counsel for the applicant points out that in pursuance of the said direction, District Basic Education Officer vide letter dated 21.05.2018 sought guidelines from Secretary, Basic Shiksha Parishad, opposite party No. 2 herein, but, since opposite party No.2 failed to provide guidelines, therefore, no decision has been taken in the matter so far.
This Court is of the opinion that before inaction on part of the opposite parties in complying with the above direction is treated as wilful disobedience of the order of the Writ Court, one more opportunity be granted to them to ensure compliance of the said order.
Accordingly, the instant contempt application is disposed of with liberty to the applicant to file a certified copy of this order along with fresh representation before the opposite parties and in which event, they shall ensure that compliance of the direction issued by the Writ Court is made within next six weeks. In case the compliance is still not made, as directed herein, it shall be open to the applicants to initiate fresh contempt proceedings against the opposite parties.
